Storage of Junked Vehicles Prohibited


A junked vehicle is defined as any old, stripped and/or wrecked motor vehicle including trucks, cars or other motorized vehicle not in good and safe operating condition, including any unlicensed vehicles stored in the open in excess of thirty (30) days.

No vehicle shall be stored or allowed to be in the open on public or private property in excess of one (1) month unless connected with an authorized sales or repair business in a properly zoned area.

The owner of the property where the vehicle is stored or permitted to remain and also the owner of the vehicle shall promptly removal of the vehicle into an enclosed building authorized to be used for such storage within the Town or to a location outside of the Town.

Whenever the Town Building Inspector or Code Enforcement Officer finds vehicles placed or stored in the open on public property within the Town, the vehicle shall be removed to a junk or salvage yard and stored there for a period of thirty (30) days. At the end of that time, the junk or salvage yard shall dispose of the vehicle unless previously claimed by the owner.

Whenever the Town Building Inspector or Code Enforcement Officer finds vehicles placed or stored in the open on private property within the Town, the owner of the property and the owner of the vehicle, if he can be located, shall be given a three (3) day written notice by Certified Mail to remove the vehicle. If not removed within the time specified, the Police Department shall have it removed by a junk or auto salvage dealer. The cost of removal shall be the responsibility of the owner of the property on which the vehicle had been placed or stored and to the owner of the vehicle if he can be located.

If the owner claims the vehicle, the junk or salvage yard shall charge a reasonable fee for handling and storage.

The above regulations shall not apply to auto salvage yards and/or junkyards authorized by the ordinances of the Town and who have been issued a permit to operate such businesses.

When any vehicle is removed and placed in storage by the Town and is not claimed within thirty (30) days after storage, it shall be sold by the Town. If proceeds of the sale are insufficient to pay the costs of removal and storage, the owner shall be liable to the Town for the balance of the costs. If the proceeds are in excess of costs, the balance shall be paid to the owners.
