Court Procedure If there is a monetary amount on your citation, and the box next to "Mandatory Appearance" is not checked, you do not have to appear in court. You may pay it anytime before your court date or call the Clerk of Courts Office (920-832-1605) to set up payment schedule. At your Initial Appearance, first, you need to check in. ( First come-first served basis, doors open at 8:00 am) Make sure you read the instructions given out at the door before you check in. Also, before you check in, you should know what you're plea is going to be. If you have a must appear on your citation, you must appear before the Judge….either today, or later at your trial if you plead not guilty. (With the exception of Operating Motor Vehicle While Intoxicated/Prohibited Alcohol Content) If you have an Operating Motor Vehicle While Intoxicated/Prohibited Alcohol Concentration citation, and wish to plead guilty or no contest, you may do so anytime prior to your Initial Appearance by calling the Clerk of Courts at 920-832-1605 to set up an appointment, or at your Initial Appearance by talking to the Clerk of Courts. She will then be able to process your paperwork. If you wish to plead not guilty, you may do so prior to or at your Initial Appearance by talking/calling the Clerk (920-832-1605). She will set a trial date for you. When you check in with the court Officer, make sure you know what you want to plea. You will then be put in the proper order for seeing the Judge for your Initial Appearance, or the Town Attorney for your Pre Trial (Plea Bargain).. When your name is called, you may proceed as directed. If you appear before the Judge, he will inform you of the charges and of the consequences of your plea, traffic demerit points, minimum and maximum forfeitures, etc. After accepting your plea, he will review the police report and your past record. You may make a brief statement. The Judge will then impose a sentence based upon the seriousness of the present charge(s) and any past record. If you opt for a Pre Trial, the Town Attorney will have a conference with you and offer you what he feels fair after reviewing the present charge(s) and any past record. If you do not want to accept his offer, you still have the option to plead not guilty and appear before the Judge for a trial that will be set by the Clerk for a later date. |
